Terms and Conditions

Cancellations and Cancellation Penalties

a. A package is considered confirmed once full payment is received by Air Credit Vacations. Cancellation of a package must be made by phone, by calling 1-855-742-0207. Cancellations will be effective immediately and subject to the penalties set forth below.

ii. ** In addition to the cancellation penalties described above, travel during special events and holiday periods (e.g., Thanksgiving, Christmas or New Year’s Day) may be subject to additional restrictions. Contact Air Credit Vacations at 1-855-742-0207 for more information.

Changes

a. Changes to a booked package are subject to the change fees described herein and cannot be made 15 days or fewer prior to departure. Notwithstanding the foregoing, some packages or package components, including, but not limited to, basic economy fare tickets, certain promotional tours, specific room categories, and activities that are identified in the booking path as non-refundable, advance purchase or restrictive cannot be changed. Certain name changes, as Air Credit Vacations may determine in its sole discretion, may be permitted without a fee. If a change to a package component involves a change in the corresponding package component rate, such package component will be repriced at the applicable rate then in effect, and full payment will be required at the time of such change. Such package components include, but are not limited to, a change in flight origin and destination, departure date, and hotel room category and/or configuration.

i. All changes to packages will be subject to the following:

A. if 16 days or more prior to the departure date: $50 per person change fee plus third-party vendor fees plus change in package price; and

B. if 15 days or fewer prior to the departure date: changes are not permitted.

ii. The applicable change fee may be waived in the following circumstances:

A. the change results in a higher price for the non-air components of the package; and

B. an upgrade from the main cabin to a premium cabin is purchased by a package participant.

iii. Air Credit Vacations will not be liable for cancellations or changes to a package that are due to events beyond its control.

Refunds

a. Within 24 hours of booking, air travel booked as a component of a package (whether refundable or non-refundable) may not be cancelled.

b. Packages are refundable only if permitted under the appropriate section above, and such package refunds will be subject to applicable cancellation penalties. Except as permitted, Air Credit Vacations will only issue refunds for entire packages and not for individual package components. No refunds will be issued or exchanges made for any missed or unused package components including, but not limited to, unused hotel nights and rental car periods.

c. All refunds hereunder are subject to the terms and conditions outlined above governing cancellations and changes, and are further subject to any such fees or other charges imposed by third-party vendors. Your acceptance of a refund constitutes a waiver of all rights and remedies under applicable laws other than the amount of the refund.

Cancellation for Convenience or Cause

a. Air Credit Vacations reserves the right to cancel a package without penalty for any reason upon 30 days’ prior written notice to you.

b. Air Credit Vacations may immediately cancel a package for cause, in whole or in part, upon the occurrence of any of the following events:

i. The package or any component thereof is used for any purpose other than personal leisure travel.

ii. The package or any component thereof is transferred or attempted to be transferred.

iii. You, as the authorized travel agent or planner of a package, as applicable, or any package participant:

A. breach any provision of these terms and conditions or any other applicable terms and conditions; or

B. engage or attempt to engage, as Air Credit Vacations may determine in its sole discretion, in any other activity that constitutes ticketing abuse or violates or is otherwise contrary to these terms and conditions or any other applicable terms and conditions.

Special Travel Requests

Third-party vendors may not have the appropriate equipment or provide the services necessary to accommodate package participants with disabilities or special needs. Please advise Air Credit Vacations of any special requests at the time of booking by calling 1-855-742-0207 at least 30 days prior to the departure date. Air Credit Vacations will thereafter forward such special requests to the appropriate third-party vendors. Additional fees and charges necessary to accommodate special requests may apply. Air Credit Vacations does not guarantee that any special requests will be accommodated.

Responsibility

a. Air Credit Vacations is not an agent of the person booking a package or of any third-party vendors. Air Credit Vacations arranges goods, services, and accommodations (e.g., excursions and tours) provided through a package by third-party vendors (hereafter referred to individually as a “package activity”). Air Credit Vacations is not responsible for the quality or delivery of any package activity, and Air Credit Vacations does not accept and expressly disclaims any liability for the actions or omissions of a third-party vendor providing a package activity. Further, your booking of a package activity while on your trip will not create a contract between you and Air Credit Vacations. Any such contract is between you and the third-party vendor providing such package activity. Air Credit Vacations will not be responsible for the provision of any package activity or for any act or omission during the course of its provision by the third-party vendor regardless of whether a member of the Air Credit Vacations staff accompanies the relevant package activity.

b. All documents issued by third-party vendors for package activities (e.g., vouchers, tickets, and passes) are issued subject to the terms and conditions specified by such third-party vendors. Neither Air Credit Vacations nor its parent(s), subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, employees, officers, directors, shareholders and agents (collectively, the “Air Credit Vacations Parties”) are responsible for any act, omission, or event during the time you are not on board the aircraft or other means of transportation arranged by Air Credit Vacations. The Air Credit Vacations Parties are not responsible for any consequential or incidental damage due to canceled flights or other transportation, whether or not resulting from acts of God or force majeure, and by accepting these terms and conditions, you waive any claims against the Air Credit Vacations Parties for such damages.

Force Majeure

Air Credit Vacations will not be liable for any failure to perform or delay in performance of any of its obligations under these terms and conditions that is caused by an event outside its reasonable control. An event outside Air Credit Vacations’ reasonable control includes, but is not limited to, acts of God (such as earthquakes, hurricanes, floods), war, terrorism, labor disputes, changes in applicable laws or regulations, and actions of governmental authorities.

Miscellaneous

a. These terms and conditions constitute the entire agreement between you and Air Credit Vacations and supersede all prior understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these terms and conditions or invalidate or render unenforceable such term or provision in any other jurisdiction.

b. These terms and conditions, and your rights and obligations hereunder, may not be assigned, subcontracted, delegated, or otherwise transferred by you without Air Credit Vacations’ prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void.

c. The terms and conditions set forth herein shall be binding upon and shall insure to the benefit of the parties hereto and their respective successors and permitted assigns.

d. No waiver by any party of any of the provisions hereof shall be effective unless explicitly set forth in writing and signed by the party so waiving. Except as otherwise set forth in these terms and conditions, no failure to exercise, or delay in exercising, any rights, remedy, power, or privilege arising from these terms and conditions shall operate or be construed as a waiver thereof, nor shall any single or partial exercise of any right, remedy, power, or privilege hereunder preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.

e. These terms and conditions shall be governed by and construed in accordance with the laws of the state of Wisconsin, without giving effect to any choice or conflict of law provision or rule (whether of the state of Wisconsin or any other jurisdiction). Any legal suit, action, or proceeding arising out of, or related to, these terms and conditions or the packages provided hereunder shall be instituted exclusively in the federal courts of the United States or the courts of the State of Wisconsin, in each case located in the City of Cheyenne, although we retain the right to bring any suit, action, or proceeding against you for breach of these terms and conditions in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

f. Any notices or other communications provided by Air Credit Vacations under these terms and conditions will be given: (i) via email; or (ii) by posting to the website. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

h. By booking a package with Air Credit Vacations, you agree to be bound by these terms and conditions and acknowledge that you have read and understand them.
